The terms of use for Pandler constitute our agreement with you, outlining our responsibilities as your service provider and your duties as our customer.

Welcome to Pandler. (“Pandler”, “we”, “us”, “our”). We are an Australian company (ABN 15 146 964 203) and offer a cloud-based software as a service (SaaS) that allows users to connect their accounting platforms and send automatic reminders to their customers and collect payments, through our website located at https://pandler.io/ (the “Service”).

Please read these terms and conditions (“Terms”) carefully. The Terms constitute a legally binding agreement between you and Pandler, and govern your access to and use of the Service.

By accessing and using our Service, you agree to these Terms and any updates we may make to them. If you do not agree to these Terms, you should not use the Service.

1. Changes to the Terms

We may modify these Terms at any time, in our sole discretion. If we do so, we'll let you know by posting the modified Terms on the Site or through other communications. It's important that you review the Terms whenever we modify them because if you continue to use the Service after we have posted modified Terms on the Site, you are indicating to us that you agree to be bound by the modified Terms.

2. Eligibility

You’re only allowed to use the Service if you are able to form legally binding contracts under applicable law. You must be at least 18 years of age. The Service is not intended for use by children under the age of 18.

7. Payments and Refunds

The payment terms will be in accordance with the pricing schedule and payment policies set out on the Pandler website. Pandler may change its fees from time to time.

8. Warranties and Disclaimers

To the maximum extent permitted by law, we make no warranties or guarantees about the Service, including that the Service will be uninterrupted, error-free or secure.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss or damage, whether in contract, tort (including negligence), equity or otherwise, arising out of or in connection with the use of our Service.

10. Indemnity

You agree to indemnify and hold us harmless from and against all damages, losses, and expenses of any kind arising out of or in connection with your use of the Service, your violation of these Terms, and/or any claims made against us by third parties as a result of your use of the Service.

11. Intellectual Property

All intellectual property rights in the Service are owned by or licensed to Pandler. You are granted a limited, non-exclusive, revocable license to access and use the Service in accordance with these Terms.

12. Dispute Resolution

You agree that any dispute arising out of or in connection with these Terms or your use of the Service will be governed by the laws of the state of New South Wales, Australia, and will be resolved by binding arbitration in Sydney, Australia.

13. General

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck out and the remaining provisions will remain in effect. Our failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.

These Terms represent the entire agreement between you and Pandler, superseding any other agreements or understandings (whether written or verbal) between you and Pandler.

By using our Service, you acknowledge that you have read these Terms and agree to be bound by them.
